1. These Terms and Conditions of Use regulate the rules to which the use of the cleanSpot app (hereinafter, the APP) is subject. The download or use of the APP attributes the condition of User to whoever does it and implies the acceptance of all the conditions included in this document and in the Privacy Policy and Legal Notice of said Web page. The User should read these conditions every time they use the APP, as they could be modified in the future.

2. cleanSpot bases part of its functionality on accessing your current location to provide you with a better experience in the use of the application since we use that location to improve the positioning service and facilitate obtaining the location of the recycling point that is is introducing. The location service (GPS) does not need to be activated for the correct use of the application. cleanSpot also allows the reception of Push and In-App notifications to show information of the favorite municipalities/localities and for the alert services integrated with the collaborating entities, so the User, in principle, accepts the receipt of These notifications although you can always block such notifications through the phone settings. The receipt of these notifications is not necessary for the main use of the APP.

3. Anonymous statistics: EYM Apps reserves the right to track your activity on the APP for future improvements and to report it to our third-party statistical service providers. All this anonymously.

4. Protection of your personal information: we want to help you carry out all the necessary steps to protect your privacy and information. See the APP's Privacy Statement and privacy notices to find out what kind of information we collect and the measures we take to protect your personal information.

5. It is forbidden to alter or modify any part of the APP to those contained therein, to evade, deactivate or manipulate in any other way (or try to evade, deactivate or manipulate) the security functions or other functions of the program and use the APP or its contents for a commercial or advertising purpose. The use of the APP for the purpose of damaging goods, rights or interests of EYM Apps or third parties is prohibited. It is also prohibited to make any other use that alters, damages or renders useless the networks, servers, equipment, products and computer programs of EYM Apps or third parties.

6. The APP and its contents (texts, photographs, graphics, images, technology, software, links, content, graphic design, source code, etc.), as well as the brands and other distinctive signs are the property of EYM Apps or third parties. , the User not acquiring any right over them by the mere use of the APP. b) Reproduce or copy the APP or its contents for private use, as well as communicate them publicly or make them available to third parties when it involves their reproduction.
c) Extract or reuse all or a substantial part of the contents of the APP.

7. Subject to the conditions established in the previous section, EYM Apps grants the User a license to use the APP, not exclusive, free, for personal use, limited to the national territory and indefinitely. Said license is also granted in the same terms with respect to the updates and improvements made in the application. Said use licenses may be revoked by EYM Apps unilaterally at any time, by mere notification to the User.

8. It corresponds to the User, in any case, to have adequate tools for the detection and disinfection of malicious programs or any other harmful computer element. EYM Apps is not responsible for damages caused to computer equipment during the use of the APP. Likewise, EYM Apps will not be responsible for the damages produced to the Users when said damages have their origin in failures or disconnections in the telecommunications networks that interrupt the service.

9. IMPORTANT: We can, without this implying any obligation on you, modify these Terms of Use without notice at any time. If you continue to use the application after making any modification to these Terms of Use, such continued use will constitute your acceptance of such modifications. If you do not accept or accept these conditions of use, you must not use the application or download or use any related software. The use you make of the application is under your sole responsibility. We have no responsibility for the deletion or the inability to store or transmit any content or other information maintained or transmitted by the application. We are not responsible for the accuracy or reliability of any information or advice transmitted through the application. We may, at any time, limit or discontinue your use at our sole discretion. 10. The User agrees to make correct use of the APP, in accordance with the Law, with these Terms and Conditions of Use and with the other regulations and instructions that, where appropriate, may be applicable. The User will respond to EYM Apps and third parties for any damages that may be caused by breach of these obligations.

11. These Terms and Conditions of Use are fully governed by Spanish law. For the resolution of any conflict regarding its interpretation or application, the User expressly submits to the jurisdiction of the courts of Spain.

In accordance with Regulation (EU) 2016/679, of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of these data (General Data Protection Regulation - RGPD), EYM Apps, informs the users of the APP, about the treatment of personal data, which they have voluntarily provided during the process of registration, access and use of the service.

1. IDENTIFICATION OF THE RESPONSIBLE FOR THE TREATMENT. EYM Apps is the entity responsible for the treatment of the data provided by the APP's clients (hereinafter, the User/s).

2. PURPOSE OF DATA PROCESSING. cleanSpot accesses your current location to improve the positioning service and facilitate the reception of notifications based on your location and we anonymously store information about the favorite municipalities / locations. We also store information about the virtual card and the point providers assigned to the card for the receipt of notifications. And also we store user interactions with the APP to provide you with a better experience in using the application. cleanSpot uses OneSignal platform to send notifications, thereby sharing your device data collected anonymously with said platform. To improve the waste detection algorithm and temporarily, the APP will be able to send data from the image taken and information about the result to our servers, so we strongly recommend that you be very careful when using this function and take photos exclusively of the waste. If the image contained personal information, it would be immediately deleted.

3. LEGITIMATION. The treatment of the User's data is carried out with the following legal bases that legitimize it:
• The request for information and / or the contracting of the APP services, whose terms and conditions will be made available to the User in any case, prior to their express acceptance.
• The free, specific, informed and unequivocal consent of the User, making this privacy policy available to them, which they will accept by downloading and installing the APP from the different Google and Apple stores.
For the use of the virtual card, the consent will be explicit when creating it.

4. PERSONAL INFORMATION. The APP does not request or store personal data since they are not necessary for its normal correct operation. Only the following personal data will be requested when creating the virtual card:
• Name or nickname
• Email
Some points providers may require an additional user identifier such as ID or similar in order to correctly process the exchange of accumulated points. This information will be requested when adding the points provider that requires it.The name or nickname can be used when preparing rankings of scores that may be of a public nature, so we strongly request that you use a nickname instead of your name in case you do not want to recognize it publicly.

5. COMMUNICATION OF PERSONAL DATA Personal data may be communicated to point providers for the provision of the virtual card service as Data Processors. EYM Apss will not make any assignment, except by legal obligation.

6. YOUR RIGHTS In relation to the collection and processing of your personal data, you can contact us at any time to:
• Access your personal data and any other information indicated in Article 15.1 of the RGPD.
• Rectify your personal data that is inaccurate or incomplete in accordance with Article 16 of the RGPD.
• Delete your personal data in accordance with Article 17 of the RGPD.
• Limit the processing of your personal data in accordance with Article 18 of the RGPD.
• Request the portability of your data in accordance with Article 20 of the RGPD.
• Oppose the processing of your personal data in accordance with article 21 of the RGPD.
